{"id":17521,"date":"2017-08-11T11:35:56","date_gmt":"2017-08-11T18:35:56","guid":{"rendered":"http:\/\/siliconeer.com\/current\/?p=17521"},"modified":"2020-11-28T18:02:47","modified_gmt":"2020-11-29T02:02:47","slug":"indian-american-transgender-girls-family-files-suit-against-school","status":"publish","type":"post","link":"https:\/\/siliconeer.com\/current\/indian-american-transgender-girls-family-files-suit-against-school\/","title":{"rendered":"Indian American Transgender Girl\u2019s Family Files Suit Against School"},"content":{"rendered":"<p><em>File photo of a sign about bathroom use at a HB2 protest rally of the new North Carolina law which denies rights to those who are gay or transgender, April 2, 2016, in downtown Asheville, NC.<\/em><\/p>\n<hr \/>\n<p>An eight-year-old Indian American transgender girl and her family have sued a California school for allegedly forcing her to wear a boy\u2019s uniform and refusing to call her by her chosen name, according to media reports.<\/p>\n<hr \/>\n<p>Parents Priya Shah and Jaspret Brar have sued Heritage Oak Private Education in California and its parent company, alleging that the school refused to call daughter by her name, the <i>Los Angeles Times<\/i> reported.<\/p>\n<p>The lawsuit, filed last week in Orange County Superior Court, alleges that Heritage Oak Private Education in Yorba Linda would not let the individual dress as she chose, use the bathroom of her choice and go by female pronouns.<\/p>\n<p>The lawsuit alleges that the school violated the Unruh Civil Rights Act, a California law which outlaws discrimination based on sex or sexual orientation, the report said.<\/p>\n<p>\u201cWhen adults at a school think that they can dictate the name that a child goes by and demand she wear a boy\u2019s uniform when she knows she\u2019s a girl, that\u2019s wrong. And that\u2019s what happened at Heritage Oak,\u201d Mark Rosenbaum, the lead attorney for the Shah-Brar family, said in a news release.<\/p>\n<p>\u201cAs a society, we can\u2019t accept such discrimination from any quarter &#8211; least of all from a school seeking to deny the identity of one of its students,\u201d Rosenbaum said.<\/p>\n<p>The suit is noteworthy because it is \u201cthe first (transgender rights) case to use a state anti-discrimination law as one of the grounds for relief,\u201d said Rosenbaum.<\/p>\n<p>\u201cIn light of the Trump administration\u2019s inaction on taking a stand against discrimination against trans individuals&#8230; this is a terribly important case,\u201d he said.<\/p>\n<p>The suit also claims that the school barred teachers from protecting her from bullying and harassment.<\/p>\n<p>The lawsuit alleged that the individual experienced social isolation. The girls would not play with her because she had to dress like a boy, and she found the boys\u2019 games too rough.<\/p>\n<p>Boys would bully the youngster, calling her \u201ca loser,\u201d it said.<\/p>\n<p>The individual left the school in February 2017.<\/p>\n<p>\u201cWe believed it was extremely important to respond&#8230; to decide when and how to inform and educate our entire elementary school community&#8230; about the mid-year change of gender identity expression of a young child&#8230; Unfortunately, these accommodations were rejected and the parents withdrew their child,\u201d according to a statement by the school\u2019s parent group Nobel Learning Communities.<\/p>\n<p>The Trump administration, meanwhile, has been rolling back Obama-era protections for transgender students.<\/p>\n<p>In February, the administration rescinded federal guidelines instructing schools to allow students to use the bathroom corresponding with their gender identities.<\/p>\n<p>Last month, the Department of Education told its lawyers they could feel free to dismiss complaints related to bathroom access.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>File photo of a sign about bathroom use at a HB2 protest rally of the new North Carolina law which denies rights to those who are gay or transgender, April 2, 2016, in downtown Asheville, NC.
